  5. Wonderful for Baker to have done this. Very unfortunate that it is only a FORMER Israeli official who does do it. And very unfortunate that Israel itself has for so long failed to defend the legality of the settlements out loud. Better late than never, certainly. But I for one wish it had come a lot sooner, and with more confidence in the strength of our case.

    I also wish that Baker had released the letter in some effective way so it could be read and known about by people other than a) the readers of the Jewish Press and b) the drone who opens Kerry's mail. Kerry himself will likely never see it. And if the State of Israel doesn't press the point officially, Kerry – who I'm guessing is not a reader of the Jewish Press — will never even confront the ideas, the facts or the legal argument that Baker has expressed.

    PLO executive committee member Zahir Muhsein made one such statement to the Dutch newspaper, Trouw, in March 5,1977. He said:

    "The Palestinian people does not [sic.] exist. The creation of a Palestinian state is only a means for continuing our struggle against the state of Israel for our Arab unity. In reality today there is no difference between Jordanians, Palestinians, Syrians and Lebanese.     On September 13, 1993, the same day Arafat and Yitzhak Rabin signed the “Declaration of Principles” embodying those ideals for which he would later get the Nobel Prize, he explained his motives on Lebanese TV:

    “Since we cannot defeat Israel in war, we do this in stages. We take any and every territory that we can of Palestine, and establish sovereignty there, and we use it as a springboard to take more. When the time comes, we can get the Arab nations to join us for the final blow against Israel.”

  38. Whilst paragraph 1 of article 49 of the Fourth Geneva Convention talks about 'forced transfer', paragraph 6 refers only to 'transfer'. Clearly, Israel is not in breach of paragraph 1, but could it be in breach of paragraph 6?

To say that land has been "stolen" implies that it was previously owned legally by another sovereign state. In the case of the West Bank it wasn't. That territory was previously controlled illegally by Jordan.

  47. Geoffrey, would it not be absurd if the Geneva 4 convention had too separate meanings for one word in one article? In any case, transfer even by itself –without "forced"– implies or connotes that the action is compulsory. Transfer is a transitive verb, as you know. Hence it does not refer to a voluntary action but a compulsory one.

  49. The idea of Article 49 as a whole is to protect those subject to transfer [and deportation] by outlawing it. Other articles of Geneva 4 are meant to protect the population of an occupied territory.
    Deportation is seen in comments by Henri Coursier, an int'l law expert, as basically synonymous with transfer. The purpose of the article was to prevent what had happened to Jews during the Holocaust and WW2, when Jews were transferred or deported from many countries to the death camps in occupied Poland.

    In any event, Judea and Samaria are NOT occupied by Israel, as Baker has made clear in other writings, including the Levy Commission Report made to the Israeli govt. Judea, Samaria and the rest of Israel were legally assigned to the Jewish National Home by the San Remo Conference [1920] and the League of Nations [1922]. So Jewish ownership of the land was recognized by international law in those acts.

  61. Dylan McInnis Israel is purely a defensive state. The ONLY reason they would ever use nukes is if someone else used one first or as a last resort (like any country would). Iran is the rouge state. They have constantly threatened Israel over the years while claiming they want peace at the same time, and the US is trying to let them continue to build nuclear weapons?   66. Dylan McInnis In case you haven't noticed, Israel is a tiny little country surrounded on all sides with either the sea, or enemy Arab countries. They HAVE to be strong and able to repel millions of people who would love to see them dead. They're not a rogue state; they are strong, smart, and always at the ready if they are assaulted in any manner. And then, they will give worse than they got, and that's only right. Kerry, Obama, Biden, and all the rest of those jerks in Congress don't speak for the people of the United States. Because we love Israel for the most part, and are solidly in support of them.

  71. I do not hold a high opinion of James Kerry, U.S. Secretary of State, but it gives me great pleasure to see someone standing up to the incessant Israeli bullying of the United States. After listening to it for 45 years, and seeing billions of U.S dollars going to Israel, I am glad someone, anyone, has the huevos to tell Israel where to go. Your unabashed shooting of Palestinian schoolchildren and your taking Palestinian lands must be halted and if someone I loath can do that, then I will give Kerry high marks if he accomplishes such. Israel no longer has the moral high ground and it is especially gratifying to me to see Israel being held accountable not only by the United States but also by a growing number of nations for its "cowboy" behavior.

    There is a new generation living and working in the world who have no experience with World War II. Most of us are tired of listening to Israel harp about the Germans and what happened during the war. That is ancient history. You have your country now. Stop whining ("exerting unfair pressure on Israel.") about everything, and start treating Palestinians like humans. Then you might regain at least some of the moral high ground. Until then, I have heard enough. And don't shoot, or otherwise maim, any more Palestinian children.

    Now, call me any and all names Jews usually do to those who dissent with Israel's official line. I know who and what I am and the Jew's typical response to call people "haters," "anti-Semites," etc. leaves me nonplussed.

    BTW, don't send the Jewish Defense League, or Mossad, or any other organization around to threaten me. I am a former United States Marine, a Vietnam veteran, I am armed to the teeth and I know how to kill. Thank you for reading this little missive. Maybe if Israel starts listening to the rest of the world, real change can come about.

  81. I am not sure if Alan Baker qualifies as one of the Jewish Press' "legal experts" (and I do not claim to be one). However I do believe that while the 49th article of the Geneva Convention was one of the consequences to the Nazi actions, its intent is to prevent occupying armies from using the transfer of citizens into those territories for political or other gains.

    There are other examples of this where the UN (and the world media and governments) has done nothing. The first that comes to mind is China's invasion and occupation of Tibet where millions of Chinese have been encouraged and sent to Tibet. I find it an unfortunate irony that Israel does not limit its connections to China. I guess the shekel speaks louder than justice when it comes to Israeli politicians.

    Anyway, The Jewish Press and Mr. Baker's attempt to attack Kerry for defending what everyone knows is the US position on settlement activity in the West Bank is typical of those whose failure to understand the depth to which Israel's settlement policy is destroying our nation from within and without.

    It is time for The Jewish Press and all the religious extremists who support these positions to understand that there is a Palestine and there exists a Palestinian People. While the Jewish ones were blessed to be part of the creation of the State of Israel, the rest have set out to create a nation of their own. Our (and your) continued efforts to prevent this by sticking your heads in the sand and ignoring reality will only continue to bring destruction to our great nation.

    I suggest that you go out and rent The Gatekeepers Film, take a dose of reality and hopefully wake up from your crusade.
