Attorney General Avichai Mandelblit has utilized a decision by retired Supreme Court Justice Salim Jubran permitting expropriation of privately-owned land in Judea and Samaria for public benefit, in order to pave an access road to the village of Haresha, in response to a request by Justice Minister Ayelet Shaked.
Jubran’s decision was handed down regarding a government plan to temporarily house the residents of the former town of Amona in a property owned by an absentee landlord, located near their former homes from which they were expelled.
The road to the community, in Gush Talmonim, has now been paved, according to TPS.
The petition to expropriate the land for public use was approved in late October by a majority of the Justices on the bench. Significantly, however, all of the judges agreed the IDF Civil Administration commander was authorized to act in the civilian interests of Israelis living in Judea and Samaria (including the Binyamin region).
The decision allows access to the village that enables the population of the new community, and is significant for the population of additional communities as well.
