Military Court on Medic Who Shot Neutralized Terrorist Recommends Parties Hold Mediation

The Jaffa Military Court heard on Monday the indictment against Sergeant Elor Azarya who is charged with manslaughter and inappropriate behavior, and the court President, Colonel Maya Heller, suggested the prosecution and the defense seek mediation. The prosecution objected. Still, the court gave the two sides until the end of the week to consider this option.

Common sense suggests that if the court gives the two sides this opening to bargain the case down from manslaughter—a felony, to misdemeanor, it is because the court does not believe the prosecution is able to prove a felony and would like to spare them the embarrassment. But the prosecution is going for broke, and has even conscripted a top attorney, Nadav Weissman, “one of the most talented litigators involved today in many of the highest profile litigation cases in Israel,” to take down the young medic.

Azarya’s attorneys are also reluctant to cop a plea, because they believe the prosecution’s own files contain all the evidence they need to acquit their client.

Incidentally, the conscripted attorney has complained through his attorneys about the prosecution’s shoddy job of preparing the evidence in the case, and they also noted for the record that they can point to precedence where the most the accused soldier received was disciplinary action.

Indeed, disciplinary action was all the medic Azarya’s commanding officers were going to do, if that, until they got the call from the defense ministry about the B’Tselem video which supposedly proves hands down that the killing of the terrorist was an act of murder.

The defendant’s attorneys are accusing the army of running a show trial for the benefit of the political echelon, namely Defense Minister Moshe Ya’alon, not the most popular man in most Israeli households these days, most notably in his own Likud party. The majority of Israelis in several recent polls believe there should have been no prosecution at all in the case.

Much of the prosecution’s case hinges on the state of mind of the accused during the shooting, namely how much he knew about the neutralizing of the terrorist and the verification that followed his neutralizing. Since he arrived some ten minutes after the incident, the fact that the verification process had been proper may not matter if the defense can establish that the accused was not aware of it, and estimated the terrorist to still be dangerous.

The case will also revolve around the application of the rules of engagement in cases where a suicide bomb is suspected. The prosecution will bring witnesses who will tell the court there hadn’t been any suicide bombers in the entire six months of a terror wave leading up to the shooting. But that may not matter in establishing the state of mind of the accused or the validity of the rules of engagement that include an expectation of a suicide bomb.

Study Shows Many UK Muslims Hold Extremist, Anti-Semitic Views

The former head of Britain’s Equalities and Human Rights Commission (EHRC), Trevor Phillips, argued that Muslims are establishing “nations within nations” in the West and admitted that he “got almost everything wrong” about immigration, in a column for the Sunday Times.

Phillips analyzed the findings of the most comprehensive study on Muslim attitudes in the United Kingdom (U.K.), which will serve as the foundation for a documentary commissioned by Britain’s Channel 4 entitled “What British Muslims Really Think.”

Many Muslims maintain significantly different values from the rest of society and prefer to live in separation, Phillips claimed.

The Channel 4 program is based off an ICM poll. It finds that more than 20 percent of British Muslims believe the country should be governed by sharia law, while close to 40 percent of Muslims – both male and female – believe a woman should always be obedient to her husband. About a third of Muslims respondents say it is okay for a man to have more than one wife, while more than half want homosexuality outlawed.

Moreover, two-thirds of British Muslims surveyed would not inform the police if they believed that someone they know became involved with terrorists. The findings also show that more than 100,000 Muslims in Britain sympathize with terrorists and suicide bombers.

The poll also revealed that British Muslims were more likely to have anti-Semitic beliefs than other British citizens. Over a third of Muslims in Britain believed that “Jews have too much power in the U.K.” and dominated the media and financial institutions. More than 25 percent questioned believe Jews are responsible for most of the world’s ongoing wars and 27 percent reported that people “hate” Jews because of their behavior.In 1997, Phillips commissioned a report about Muslims in Britain which introduced and popularized the ‘Islamophobia’ label that is now synonymous with any criticism of Islam or Muslims. He now admits that report failed to predict many individuals within Muslim communities hold radical views and do not seek to integrate into British society.

“It’s not as though we couldn’t have seen this coming. But we’ve repeatedly failed to spot the warning signs,” Phillips wrote in the Times.

In a Daily Mail article, Phillips describes a “life-and-death struggle for the soul of British Islam,” arguing that extremists have infiltrated in some Muslim communities and drowned out moderate Muslim voices.

“Indeed, a significant minority of Britain’s three million Muslims consider us a nation of such low morals that they would rather live more separately from their non-Muslim countrymen, preferably under sharia law,” Phillips says.

Phillips also warned of Islamist hardliners taking over UK schools and imposing a radical agenda, as evidenced by the ‘Trojan Horse’ case in Birmingham. These developments led Phillips to call for more robust measures and strict monitoring to mitigate the emergence of “ghetto villages,” or ethno-religious enclaves that remain separate from the remainder of society.

Radical sentiments among Britain’s Muslim community reflect research from across Europe that suggests Muslim attitudes are becoming more extreme, particularly among younger generations.

France Calling for Use of Force in Syria

French foreign minister Laurent Fabius told BFM-TV today that “if it is proven, France’s position is that there must be a reaction, a reaction that could take the form of a reaction with force.”

He added that “there are possibilities for responding,” but refused to elaborate. He did state that if the UN Security Council could not make a decision, one would have to be taken “in other ways.”

Syrian government officials said the claims of an army chemical weapons attack on its own civilians were “totally false” and the news outlets reporting those claims were “implicated in the shedding of Syrian blood and support terrorism.”

Turkey’s deputy prime minister has said only the Syrian government is in possession of the type of chemical weapons the opposition claims were used in the attack. Turkey’s foreign minister said “all red lines” have been crossed by the Assad regime.

But Iran has rejected the claims that its ally, President Bashar Assad, had deployed chemical weapons, saying the rebels would be responsible, if such an attack had really taken place.

“If the information concerning the use of chemical weapons is accurate, very definitely they were used by terrorist groups… who have shown they will not hold back from committing any crime,” Iran’s foreign minister Mohammad Javad Zarif said to the IRNA news, referring to the rebels.

British Foreign Secretary William Hague urged international supporters of the Syrian regime to “wake up to … its murderous and barbaric nature” ahead of the UN meeting, Sky News reported.

But Russia, the traditional supporter of the Assad regime, suggested the attack could be a “premeditated provocation” by opposition forces.

Officials from Russia and China are reported to have blocked a stronger press statement supported by Britain, France, the US and others, Sky News reported.

Earlier, Mr Hague said that if verified, the attack “would mark a shocking escalation in the use of chemical weapons in Syria”.

He added: “Those who order the use of chemical weapons, and those who use them, should be in no doubt that we will work in every way we can to hold them to account.”
