Shabak Issues Last Administrative Detention Order Before Lieberman Takes Over

Only days before MK Avigdor Lieberman (Yisrael Beiteinu) takes over as defense minister, the Shabak secret police on Friday issued an unprecedented administrative detention, ordering a Jewish youth to avoid contact with a list of 87 individuals, legal aid society Honenu announced Monday morning. The decree, issued by GOC Home Front Command Major General Yoel Strick, also ordered the same youth to be under house arrest at night. An additional decree, signed by OC Central Command Major General Roni Numa, bans the same youth from entering Judea and Samaria.

Like all administrative detentions, the orders against this youth do not mention any charges pending against him, or even any specific suspicions. The reason for the severe limits on his civil rights is stated as: “To secure state security, public peace, and maintaining public order.”

Israeli citizens could probably observe on Monday to see if any of the above conditions have improved following these orders, which were issued on the recommendations of the Jewish section of the secret police.

Administrative detentions have been the modus operandi of outgoing Defense Minister Moshe Ya’alon, who used them generously in place of thorough police investigation. His reign will be remembered, among other things, for the torture interrogations of Jewish suspects for long weeks without access to an attorney or their families. Considering Ya’alon’s repeated concern for Israel’s democracy, it’s evident he probably did not complete the entire course on this subject.

Honenu’s statement included the organization’s hope that “the new defense minister will learn this subject during his grace period, and maybe succeed in stopping the values that have already been falling down this slippery slope.”

Meanwhile, it is unclear whether Meir Ettinger, the grandson of the late Rabbi Meir Kahane, will be released from his ten months of administrative detention, imposed by Ya’alon last August.

Meir Kahane’s Grandson May Be Released from Administrative Detention

After ten months of administrative detention in an isolation cell, without charges or an indictment, never mind a trial, prisoner Meir Ettinger, grandson of the late Rabbi Meir Kahane, is expected to be released—probably to home detention, a Shabak representative told the Lod District Court on Tuesday.

The court ruled that the clandestine police must determine in one week which limiting conditions it would like to see placed on Ettinger after his release, possibly on June 1.

Last summer, while he was being interrogated by the Jewish Section of the Shabak, Ettinger was presented with a six-month administrative detention order signed by Defense Minister Moshe Ya’alon. A few weeks later, an additional administrative decree signed by Ya’alon moved Ettinger to an isolation cell when the prison authorities expressed concern that Ettinger was influencing the other prisoners. When the six months were up, Ya’alon signed another, four-month decree, the maximum allowed by law for an extension.

One month ago, the rightwing public was enraged when Ya’alon refused to allow Ettinger to leave jail for a few hours in order to attend his firstborn son’s circumcision in Jerusalem.

So far, Meir Kahane’s great-grandson, Netzach Binyamin, who is two months old, has not been served with a Ya’alon administrative detention writ, though the prison authorities did suggest the brit mila be performed in jail.

Ettinger Family Protest Non-Release for Son’s Bris

Meir Ettinger, the grandson of Rabbi Meir Kahane, has been sitting in jail for the past 8 months, and hasn’t been charged with a crime.

He is being held under administrative detention rules, and most of the time in isolation – after prison services claimed he was influencing other prisoners with his political ideology.

The bris (circumcision) of Ettinger’s firstborn son will be held on Monday, and on Sunday at 10 AM a Be’er Sheva court will be decide if Ettinger can attend or not.

Ettinger’s family held a protest in Jerusalem on Saturday night at the Bridge of Strings (Chord’s Bridge) demanding Ettinger be allowed to attend to his son’s brit mila.

Ettinger is being represented by a lawyer from Honenu.

The Israeli prison services are against his release.

Shin Bet Arrests Grandson of Meir Kahane for ‘Nationalist Crimes’

Investigations by the Israel Security Agency (Shin Bet) have led to the arrest of 24-year-old Meir Ettinger, grandson of the late Rabbi Meir Kahane, on suspicion of nationalist crimes.

Sources said he was not specifically accused of involvement in last Friday morning’s firebombing of two homes in the Samarian village of Duma, where an 18-month-old baby died in the ensuing fire. The baby’s mother and a brother suffered serious burns.

Ettinger has been described as “the unofficial leader of the hilltop youth and has been barred from Judea and Samaria since January. Police arrested him in Safed (Tzfat).

His grandfather Rabbi Kahane, who was assassinated in 1990 in New York City, founded the nationalist Kach movement that the Israeli government eventually outlawed after Kahane was elected to the Knesset.

Ettinger allegedly was the mastermind who organized the arson of a church on the shores of the Sea of Galilee (Kinneret) in June and for which the Shin Bet has arrested five suspects.

It can easily be speculated that interrogations of the suspects exposed enough evidence for the Shin Bet to arrest Ettinger.

He is scheduled to appear in court this morning (Tuesday), where police will almost certainly ask that he remain in custody until the end of judicial procedures.

The government this week approved “administrative detention” for so-called Jewish terrorists, a move that makes it easier for the court to put Ettinger in jail for several months pending a trial.

Ettinger has denied that there is an underground movement in Israel but has written on his website that mosques and churches are places of “pagan worship” and that

He also wrote:

There is no terrorist organization, but there are lots and lots of Jews, much more than what they think, whose ladder of values is completely different from that of the High Court of Justice or the Shin Bet.

Ettinger wrote on Arutz Sheva in May:

The Nationalist Crimes Unit [of the Shin Bet] was created three years ago by Tzipi…to eradicate nationalist crimes, i.e. actions of what are known as Jewish ‘rebels’ who, for their part, feel that they are acting to prevent the further deterioration of the state of Israel.

The officials in this unit harass those they suspect and try to put as many as possible behind bars….

When a Jew’s blood is spilled in a terror attack, they go from yeshiva to yeshiva, town to town, to insure that there will be no response, other than an op-ed column by a family member…..

The fact is that the security services have been acting for a long time now as if the main enemy of the State of Israel is Jewish children who move to the hills of Judea and Samaria (‘Hilltop Youth’) and that helping these youngsters is akin to treason….

The Unit has declared us the enemy.

Arab MK Ahmed Tibi Flies PLO Flag on Temple Mount

Arab Knesset Member Ahmed Tibi celebrated the traditional birthday of the Muslim prophet Mohammed Saturday by hoisting a PLO flag on the Temple Mount and declaring it the capital of Palestine.

Tibi also criticized the United States for voting last week against the U.S. Security Council resolution that Israel must sign a peace treaty with the Palestinian Authority within one year based on PA demands and surrender half of Jerusalem, Judea and Samaria within three years.

Police did nothing to stop Tibi.

Public Security Minister Yitzchak Aharonovitch, who has said that Jewish Knesset Members should not be allowed even to visit the Temple Mount, has said nothing.

Defense Minister Moshe Ya’alon, who has called Jewish MK visits on the Temple Mount a “provocation,” has said nothing.

Lawyer Yossi Fuchs fired off a letter Saturday night to Attorney General Yehuda Weinstein, demanding that he act against MK Tibi just as he has acted in the past against anyone raising a flag stating ”Kahane Lives.”

Israel has declared Kahane Chai is an illegal group. Fuchs wrote Weinstein that the court has declared that the PLO is a terrorist group and argued that Tibi, by flying the PLO flag, violated the law concerning the prevention of terror.

What are the chances that Weinstein will even consider investigating Tibi?

Transfer: Still The Only Solution

The hatred is so thick, you can feel it in another country. The world screams for our blood. European politicans lean on Israel hoping to snap us in two. Crude pundits and politicians spew the kind of filth once found in JuluisStreicher’s pornographic rag. Jewish neighborhoods burn throughout Europe because Israel has the audacity to defend itself.

 

On American soil, Obama shows us why he has earned the title of most anti-semitic President in U.S. history.  He can’t even hide it on his arrogant mug, nor does he wish to. John Kerry proves himself a worthy heir to Hillary. I imagine a job application for the U.S. Secretary of State includes the following question: What unique brand of anti-semitism does your skill set bring to the table?

 

As always, one can only find solace in the Torah, and more importantly, in its application. Hence the appropriateness of this week’s Torah reading. How tragically ironic that while our soldiers (may The Almighty preserve them) are fighting the Arab Amalekites in the ancient region of Azza, we will be reading the weekly Torah portion which remains the sole blueprint for dealing with our enemies. The Torah speaks concretely and without ambiguity.

 

ParshatMasai. “Vehorashtem”- “You shall drive out all the land’s inhabitants before you, and you shall destroy all their prostration stones, all their molten images you shall destroy, and all of their high places you shall demolish.” (Numbers 33: 52-53) 

 

“If you do not dispossess the inhabitants of the land, those whom you allow to remain shall be barbs in your eyes and thorns in your sides, and they shall harass you in the land in which you live. Then, I will do to you what I had planned to do them.” (Numbers 33:55-56)

 

You will note that the verse makes no mention of not harming “innocent civilians.” I had to point that out.  

 

The OhrHaChaim (classic Pentateuch commentary of Rabbi Chaim Ben Attar) addresses this issue. “You must drive out”. Although the verse said of the seven nations “you shall not allow  any people to remain alive” (Deut. 20:16) Here, the Torah is talking about other nations found there beside the seven. It therefore was careful to say, “all the lands’ inhabitants,” meaning, even those not of the seven. (Numbers 33:52)

 

In summation, the notion of ridding the land of hostile/dangerous elements is not limited to the historical seven nations that the Jewish people faced upon entering the land. It is a template that applies to enemies in all generations.

 

Many Jews, including too many religious ones, are uncomfortable with the Torah’s words and would like to relegate them to the shelves of ancient history. Those who don’t see the Torah as the literal word of The Almighty readily dismiss it as an ancient war- ethic that has no applicability in a modern age. Some will deem it barbaric by modern standards. There are many with kipot who will utilize more elaborate ways to evade the halachic requirement. Some are clever enough to argue that this, like Israel’s other wars is a milchement mitzvah (biblical war-the correct general consensus of religious Zionists) but yet somehow maintain that the other elements of the mitzvah don’t apply.

 

Those who are honest enough to state the halachic truth without compromise are few and they are demonized. In our times, only one prominent person dared to address this provocative issue. Naturally, I speak of the great Rabbi Kahane (may G-d avenge his blood) whose brilliant prose graced the pages of the Jewish Press for many years, ensuring that Jews would get an education they were unlikely to receive elsewhere. His magnum opus, entitled “They Must Go!” is a must read for anyone interested in Israel’s survival. It was a terrifying read back in the 1980’s before Oslo. Today it is a nightmare read that would be classified as horror were it not the truth. And for his honesty, the left and the right (the reasonable, respectable right) rose up and outlawed Rabbi Kahane’s KACH party which was slated to win approximately 10-15 seats in the next Knesset. What did Rabbi Kahane do to raise their ire?
