Newcomer Rabbinic Organization Launches Lower East Side Eruv Against Establishment View

The Downtown Va’ad, an Orthodox rabbinic network established in 2013 as a “unifying platform for Orthodox rabbis to advance the welfare and flourishing of our now surging downtown Jewish community,” on Thursday announced the establishment of an eruv, a legal fiction allowing Jews to carry objects on Shabbat.

“As of today, all of Lower Manhattan has been joined to the larger Manhattan Eruv,” declared the group’s announcement, defying a generation of Orthodox scholars, most notably the late Rabbi Moshe Feinstein, who was the halakhic authority for North America’s Orthodox community until his death in 1986. In the 1950s, Rabbi Menachem Mendel Kasher proposed the establishment of an eruv in Manhattan, but the Lithuanian yeshiva deans, including Rabbis Aharon Kotler and Moshe Feinstein, objected to the idea. The major controversy that ensued was resolved by a statement from Agudas Horabonim (Rabbis’ Association) which quashed the Manhattan eruv for the next fifty years.

The Downtown Va’ad’s press release recalls the process that brought the new Manhattan eruv to life: “In 1999, a new eruv was constructed on the Upper West Side under the advisement and supervision of the Machon L’Hora’ah of Monsey. In 2003, this Eruv was extended to include the Upper East Side community, and then in 2007 — with the assistance of Yeshiva University (Stern College), local congregations, and several individuals and families — the eruv was expanded to include a portion of the downtown community. … Recently, the Manhattan eruv was further extended to include the entire southern portion of Manhattan, specifically the region below 14th Street. This project was initiated by the Downtown Va’ad in conjunction with the Manhattan Eruv leadership. … The extension was facilitated and supervised by the Machon L’Hora’ah and continues to be checked and maintained by them. All halakhic (legal) matters are deferred to the Machon.”

According to the press release, “this eruv development is simply the expansion of the pre-existing eruv; one that most Manhattan rabbis have publicly supported. We understand that the halakhic institution of eruv is complex and we honor and respect all rabbinic and communal perspectives on the matter. We encourage our constituencies to pursue guidance from its own rabbinic authorities and to continue the spirit of mutual respect and dignity that Jewish practice demands and engenders.”

The new initiative is likely to raise an objection from the traditional Orthodox leadership of the Lower East Side community, led by Rabbi Moshe Feinstein’s sons, Rabbis Dovid and Reuven Feinstein. These legal scholars follow their father’s view that in densely populated Manhattan it is impossible to ever erect a legitimate eruv. Hopefully, the Lower East Side community, which is one of the most benign Jewish communities in America, will weather this storm, especially in light of the fact that we’re entering the Days of Awe.

The simplest possible explanation regarding the halakhic dispute over the eruv goes as follows:

Jewish law recognizes three domains: private domain, where one may carry on Shabbat; public domain, where one may never carry on Shabbat; and an in-between domain nicknamed K’Armelit, meaning “like a widow,” who is not married and not a virgin. A Karmelit domain can be converted into private domain using a symbolic wall and doorway, usually represented by a fishing line attached to poles all around the converted area.

No one disputes that part. What is being contested is the definition of a public domain which cannot be considered a karmelit and therefore cannot ever be converted into a private domain, no matter how much fishing line you’ll tie around it.

The late Rabbi Feinstein followed the view cited in the Shlchan Arukh (OH 345:7), based on a Babylonian scholar cited by Rashi, that since the laws of Shabbat domains are delineated from the configuration of the Israelite’s camp in the wilderness, which was considered an irredeemable public domain, and since there were 600,000 males over the age of 20 in that camp, we should view any area populated by 600,000 people or more as public domain.

Many disagree with this view, because it isn’t mentioned explicitly in the Babylonian or Jerusalem Talmud, nor by Maimonides and other key medieval scholars. Also, does the rule mean there should be 600,000 people moving through the place or living there for it to qualify as public domain, and should they all be males older than 20?

The opposing view, which the new rabbinic group seems to uphold, is based on an explicit Talmudic citation (Shabbat 6a), defining public domain as a main road, 20 feet wide, going through a city from one end to the other, connecting to other cities in either direction. Imagine the cities of antiquity as an aspirin pill, with the line going through the middle. That’s the road, and the fact that it is connected to the wilderness on either end makes it a Mavo Mefulash, a passageway that’s open on both ends. Since Manhattan does not have such a road leading to the wilderness, goes this view, it can be turned into one big private domain via the eruv. Alternatively, if one were to consider the bridges and tunnels leading into Manhattan a problem in that context, then each local community, such as the Lower East Side, can erect its own eruv — meaning one cannot carry into neighboring communities on Shabbat, but one is permitted to carry in one’s own neighborhood – see the accompanying image above.

One is reminded of the story of two study partners who have been poring over the Talmud together for years, and one of them invites the other to his son’s wedding and wants to honor him with one of the blessings to the couple under the canopy. His partner says he is, indeed, honored, but, alas, he isn’t Jewish.

– What do you mean you’re not Jewish? We’ve been learning together all these years…

– I’m interested in it intellectually, but it doesn’t make me a Jew.

– Wait a minute, I see you on the street on Shabbat in your suit and tie — you know a goy gets the death penalty for observing Shabbat! (It’s actually the law, look it up)

– I take care of that by always carrying something in my pocket.

– Yes, but we have an eruv!

Head of Search in TA Building Collapse, as 3rd Dead Discovered: Time Not on our Side

“Time is not on our side,” said Home Front Command chief for the Metropolitan Tel Aviv District Colonel Amir Ulu, who described the challenges facing hundreds of rescue workers at the collapsed building where three have died—the third victim discovered Tuesday morning—and 23 injured so far. On Monday night the rescuers lost contact with two victims who until then could be heard from under the layers of dirt and destruction. “The more time passes, the more problematic it becomes to find living victims, although in the past we’ve rescued collapse victims after 30 hours,” Ulu said.

As dark was setting at the collapsed, 4-story parking garage under construction in Ramat HaKhayal in north Tel Aviv, the rescue teams mapped the construction site, but the dimensions and sheer mass of the detritus and debris posed a significant difficulty. “It can take us hours to reach each one of the mapped areas,” Yonatan Raz, Ulu’s deputy, told Walla. “But the command’s decision is that we’re not leaving. We have the capacity to remain here for 48 hours, with the hope of finding trapped victims who are still alive.”

The rescuers believe there are four more people under the collapsed structure. Overnight the site was flooded with high voltage lights and shifts were changed frequently, to maintain the workers’ alertness. The rescuers are fearing additional collapses in two spots, which they continue to monitor. “The structure has stopped moving, which is good news,” Ulu said Tuesday morning.

Ulu related that only a week ago, commanders from the Home Front Corp, Police and MDA underwent a course intended to regulate communications between them in the event of a major disaster, “And here we are, applying what we’ve learned, unfortunately,” Ulu concluded.

Syrian Mortar Lands on Israeli Side of the Golan

An stray mortar from fighting on the Syrian side of the Golan Heights landed on the Israeli side of the border at around 7 PM on Monday evening.

The IDF reports no injuries or damage from the strike.

The Israeli Air Force hit back at the source of the mortar fire.

AP: Secret Iran ‘Side Deal’ Allows Tehran To Accelerate Nuclear Development

When the P5+1 deal was first revealed the review on these pages after reading it, was “there is no other way to describe the Iran deal—it stinks!” Associated Press reporter George Jahn did something I didn’t think was possible, in an exclusive report on Monday he revealed that the Iran deal was even worse than we first thought. Jahn got hold of a secret side deal which allows to upgrade its centrifuges and increase its enriching capacity, all before the deal officially expires in 15 years. The projection is this will reduce the time for Iran to build a bomb to 6 months instead of the year time frame that was promised.

The document is the only part linked to last year’s deal between Iran and six foreign powers that hasn’t been made public. It was given to the AP by a diplomat whose work has focused on Iran’s nuclear program for more than a decade, and its authenticity was confirmed by another diplomat who possesses the same document.

The diplomat who shared the document with the AP described it as an add-on agreement to the nuclear deal. But while formally separate from that accord, he said that it was in effect an integral part of the deal and had been approved both by Iran and the U.S., Russia, China, Britain, France and Germany, the six powers that negotiated the deal with Tehran.

One of items that was fuzzy in the public version of the P5+1 deal is what happens between years 10 and 15. Mr. Jahn’s scoop explains that period, “It says that as of January 2027 – 11 years after the deal was implemented – Iran can start replacing its mainstay centrifuges with thousands of advanced machines.” Those advanced centrifuges are about 5x more efficient than the centrifuges it now uses. They will only be allowed between 2,500-3,000 of the high-tech centrifuges but because they are better at enriching uranium, Iran will be able to enrich at twice the speed as before.

As a result, Obama’s promise that the Iran deal would ensure that Iran would need at least a year to “break out” to a bomb was (not surprisingly) a lie.

But based on a comparison of outputs between the old and newer machines, if the enrichment rate doubles, that breakout time would be reduced to six months, or even less if the efficiency is more than double, a possibility the document allows for.

The document also allows Iran to greatly expand its work with centrifuges that are even more advanced, including large-scale testing in preparation for the deal’s expiration 15 years after its implementation on Jan. 18.

(…) A U.S. official noted, however, that the limit on the amount of enriched uranium Iran will be allowed to store will remain at 300 kilograms (660 pounds) for the full 15 years as well as being restricted to a level used for reactor fuel that is well below weapons grade. Like the diplomats, he too demanded anonymity because he wasn’t authorized to discuss the document.

In other words, the deal sets them up with the centrifuges necessary to go nuclear six months after the expiration of the deal.

In the Iran deal as first presented did not require Iran to close a single nuclear facility, not one centrifuge gets dismantled, some of Iran’s stockpile of enriched uranium gets “converted” but all of it stays in the country. Their entire nuclear infrastructure remains intact, they gets to continue its nuclear research, the ballistic missile program continues, the sanctions come off as Iran complies, and while there are provisions for sanctions to snap back, any such action needs to be approved through the U.N. Security Council and vetoes from Russia and/or China.

Thanks to the AP’s Mr. Jahn we learn that it also helps Iran cut the time it needs to leap to a nuclear bomb from a year to six months. And thanks to Barack Obama, the United States of America, our Sunni allies in the gulf region, and Israel are in worse danger than before.

7-Eleven on Grand Street

To most of our readers around the globe, this might not mean much. But the idea of having a 7-Eleven outlet on Grand Street, on the very hallowed ground where Jewish immigrants—workers and scholars, poor and relatively less poor—have set foot for the first time in America… Well, frankly, I’m not sure what it means, but it certainly signals change. The Lower East Side is Moishe’s Bakery, not Denny’s. It’s small, individualized, personal—not a chain of identical stores selling identical products to millions.

20130731-115350Speaking of change, according to my friends at The Lo-Down, the website serving the old neighborhood with hyper-local news and tidbits, the first customer to purchase anything at all at the new 7-Eleven was my good friend and former client, Jacob Goldman, of Loho Realty, a man who’s been embracing change on the Lower East Side since change became in again.

My daughter was absolutely overjoyed with the news—she’s been a documented Slurpee addict since Slurpee was recognized as an addiction by the APA. My daughter declared she was starting to save for a ticket back, to have her frozen flavored drink.

And so the battle is being waged – Zionism and national renewal versus Slurpee. And I’m not betting on that one.

Temple Mount Closure And EU Boycott

On Tisha B’Av Prime Minister Netanyahu dramatically declared that Israel would not allow foreigners to interfere with our borders. This may have sounded like good news to local ears, but on the very same day the prime minister contradicted his own policy.

On the morning of Tisha B’Av, hundreds of Jews, among them three Knesset members, attempted to enter the Temple Mount – but were denied access. The next day Deputy Foreign Minister Ze’ev Elkin made a second attempt to enter the Mount but was turned away. When MK Yariv Levin asked about this fiasco in the Knesset plenum, Internal Security Minister Yitzhak Aharonovich answered, as usual, that there is no policy change regarding the Mount and that anyone who wishes to enter can do so. He said that Jewish visitors enter the Mount every day with no problem and that the closure of the Mount to visitors (including Knesset members) was the security decision of the local commander.

Aharonovich knowingly lied to the Knesset. Everyone involved with the Temple Mount issue knows that since Netanyahu acquiesced to the demands of the Muslim wakf and denied me access to the Temple Mount, police control of the holy site has rapidly deteriorated. The Temple Mount has become a staging ground for a vicious struggle, with cries of “kill the Jews!” becoming routine there. Jews are consistently distanced from the Mount and Israel’s police project unprecedented spinelessness, fear and defeatism in the face of the burgeoning brazenness of the Muslim wakf.

Israeli police have all the means at their disposal – if they choose to use it – to disperse the Arab rioters within minutes and to make it possible for the Jews to visit their holiest site. But, as it is wont to do, Israel’s police adopted the role of security fig leaf for the prime minister, who is giving the holy Mount’s sovereignty to Jordan and the Muslim wakf – while talking mightily about not allowing foreigners to interfere in Israel’s sovereignty.

Aharonovich claimed that the Mount was closed, due to security considerations, as per the decision of the local commander. But there is a truly reliable side to this story contrary to his version of events. Here is the relevant part of the Jordan News Agency’s July 16 report from Ramallah:

Israeli Police Prevent Jewish Extremists From Entering Al-Aqsa Compound Due To Demand By Jordan

Following the pressure exerted by [the] Jordanian government on the Israeli authorities, the Israeli police on Tuesday closed the Mughrabi Gate, one of Al-Aqsa Mosque’s doors, and prevented Jewish extremists from entering it.

Director of the Islamic Waqf in occupied Jerusalem, Sheikh Azzam Al-Khatib, told Petra [News] that the Israeli police closed the gate and prevented extremists and foreign tourists from entering Al-Aqsa compound today, “the anniversary of the destruction of the Temple,” after Jordanian pressure and intervention by the Department of Islamic Waqf and [the] Jordanian ambassador in Tel Aviv, Walid Obeidat.

He confirmed that the ban came as a result of the intensive communications undertaken by Jordan to prevent the desecration of Al-Aqsa during the holy month of Ramadan. Al-Khatib praised the vital Jordanian role in protecting Jerusalem and the holy sites.

This report, verified by additional sources, is nothing new. The prime minister has used the police, the attorney general’s office and the courts before in his quest to implement a political decision when wanting to cede sovereignty on the Temple Mount to the Muslims. And he’s done this without the Knesset’s authorization. This is how issues surrounding the Temple Mount have been disposed of since it was liberated. Netanyahu has simply expanded the practice.

The capitulation on the Temple Mount leads to the construction halt in Jerusalem. In other words, the organs close to the heart become infected with the same illness: the loss of sovereignty syndrome. In this manner, our existential legitimacy in the entire land is crumbling before our eyes.

What do we expect of the European Union? After all, for 46 years we have been saying that the land of Israel is theirs – not ours. We hurried to give the heart of Jerusalem and the nation, the Temple Mount, to the Muslim wakf. We refused to declare Israel’s sovereignty in Judea, Samaria and Gaza. We recognized another, conveniently invented “nation” as indigenous to the land, recognized its terrorist liberation movement, and armed it with Israeli weapons. We vowed to retreat so as to enable the establishment of a state for this make-believe “nation” in the heart of biblical Israel. We expelled and destroyed entire Jewish communities. We committed ourselves to the two-state principle.

But over the past 20 years not one of our leaders, at any level, has said that this is our land – no ifs, ands, or buts. This straightforward phrase simply does not exist in the lexicon of Israel’s political and military leadership.

So why are we surprised that the Europeans are tired of this entire subject? It took them 46 years to be convinced that we are serious that this really is not our land, that we are nothing more than foreign conquerors in Palestine. Perhaps the Arabs are not nice, they think, but they are very, very right on this issue. After all, Israel’s political Left and Right have both bowed to their claims and recognized the justice of their cause. Yitzhak Rabin shook the hand of their murderous leader, while Netanyahu hugged him with both his hands. So what can we expect: that after we have admitted that we are the problem, the Europeans will allow us to continue to threaten world peace?

We no longer have anywhere to run from the scales of justice. When you do not put your weight on one side of the scale, the other side is heavier. You can be prettier, nicer, more European – and even a peace seeker. But if you have abandoned your side of the scale, the other side will always win.

We lost the justice of our cause when we gave the Temple Mount to the Muslims. The only way to restore our justice is to remove the Muslim wakf from the Mount and to empower our holiest site as the center of holiness and exclusive sovereignty of Israel.
