When Tisha B’Av Occurs On Shabbat Or Sunday

Five tragedies occurred on Tisha B’Av. It was decreed that those who left Egypt would not enter the land of Israel, the first and second Temples were destroyed, the city of Betar was captured with thousands massacred, and Turnus Rufus plowed the site of the razed Temple. Consequently, Tisha B’Av was declared a day of national mourning and a fast day.

The fast of Tisha B’Av begins at sunset on the night preceding the fast day itself. In order to prepare oneself for the fast, the accepted custom on a weekday is to eat a regular meal without meat and wine before Minchah. Following Minchah, the last meal before the fast, the seudah mafseket, is consumed.

This meal, eaten sitting on the floor, consists of bread, water, and an egg dipped in ashes. The seudah mafseket may not be eaten as a family meal but rather as an individual one, each person in his or her own corner with Birkat HaMazon recited by each person for himself without a mezuman.

When Tisha B’Av occurs on Shabbat, the fast is postponed. It begins on Motzaei Shabbat and ends Sunday night. When the fast is postponed to Sunday or when Tisha B’Av occurs on Sunday, the final meal eaten before the beginning of the fast is the seudah shelishit, the third meal of Shabbat.

Since it is still Shabbat, during which mourning is prohibited, none of the restrictions of the seudah mafseket described above apply. Accordingly, one may eat meat, drink wine, sit around the table, and recite Birkat HaMazon with a mezuman, and there is no requirement to dip an egg in ashes. The only difference between this seudah shelishit and others eaten during the year is that this one must be terminated before the sun sets and the fast begins.

Because the words of Torah gladden the heart, studying Torah is forbidden when Tisha B’Av is on a weekday, except for passages in Scripture that deal with the destruction of the Temple and other calamities. When Erev Tisha B’Av or Tisha B’Av itself occurs on Shabbat, Torah may be studied, without restriction, on Shabbat morning and, according to many opinions, also on Shabbat afternoon. At Minchah on Shabbat Tisha B’Av or Shabbat Erev Tisha B’Av, the prayer Tzidkotchah is omitted as well as Pirkei Avot.

When Erev Tisha B’Av or Tisha B’Av itself occurs on Shabbat, the prayer V’he Noam is omitted because it was composed for recital at the inauguration of the Temple, whereas Tisha B’Av commemorates the destruction of the Temple. The prayer of Vayitein Lechah is also omitted. Kaddish Shalem is recited without Titkabel.

The procedure with Havdalah is as follows: For those who are fasting, first, the Havdalah blessing, Ata Chonantanu, is recited in the Amidah. Then, before reciting Megillat Eichah, the blessing Borei Me’orei Ha’esh is recited over candlelight but the other blessings usually recited at Havdalah are omitted. Neither wine nor besamim is used on this Motzaei Shabbat. On the evening following the fast, Sunday night, the Havdalah blessing that was omitted on Motzaei Shabbat is recited over wine, but neither flame nor besamim is used. Those who are not required to fast recite Havdalah on Motzaei Shabbat but use a Chamar Medinah beverage (such as tea, coffee, or beer).

When Tisha B’Av occurs on a weekday, leather shoes are removed before sunset. When Erev Tisha B’Av or Tisha B’Av occurs on Shabbat, individuals, in order not to display signs of mourning on Shabbat, remove their leather shoes at Ma’ariv after reciting Barchu. The chazzan first recites Baruch Hamavdil bein Kodesh Lechol and then removes them before Barchu.

When Tisha B’Av occurs on a weekday, Tachanun is omitted at Minchah on Erev Tisha B’Av and on Tisha B’Av itself, just as it is not recited on a day of celebration. This is because we believe the Temple will eventually be rebuilt on Tisha B’Av, which will then become a day of celebration.

Hebron Shooting Soldier Azaria’s Testimony Starts Sunday

The testimony of the soldier Elor Azaria who shot dead a terrorist who was lying on the ground, already neutralized, begins Sunday morning in military court in Jaffa. Azaria will answer questions from his own attorneys, and then from the military prosecutor, one of Israel’s top criminal litigators, who was conscripted by the army to improve its chances of getting a conviction.

Last week the prosecution completed presenting its own witnesses, including senior officers, military police investigators, enlisted men and women and NGO B’Tselem cameramen.

Sundays Off, Sort Of

A compromise was reached in the debate whether Israel should have a longer weekend and a shorter work week by giving Sundays off.

Those in favor see Sundays off as a way of improving the religious-secular divide, where the two main sectors of Israeli society can’t interact on the one real day off Israel has – the Shabbat. They also hope to increase worker productivity by better balancing work and family time, and reducing worker exhaustion.

Those who oppose it, see the loss of productivity and economic benefits that Israel gains from having a weekly jump start on the rest of the global market.

On Friday, many people work half-days, if at all.

The Ministerial Committee for Legislation approved a draft that would provide six long weekends a year starting in 2017. The weekend would begin on Thursday evening and end on Monday morning, so it’s more of a long weekend bill than a Sundays off bill.

The number of school days won’t be affected by the law, a major concern by parents who feel there are too many school vacation days as it is.

Two of the long weekends will be during the summer, the remaining four will be deducted during the Pesach and Chanukah holiday season.

That coincides with the periods most people take vacations anyway, because schools are off, and families are forced to synchronize their work vacations around the school schedule.

It is expected that the bill will pass its preliminary reading in the Knesset.

Big ‘Nakba’ Protest in TAU this Sunday, Watch this Space for Updates

This Sunday, May 15, at 11:00 AM, at Tel-Aviv University’s Antin Square, the annual Nakba (Catastrophe) commemoration ceremony will be held by the TAU Arab/Radical-Left students. Our friends at Im Tirtzu will be holding a “Nakba Charta” (Nakba Nonsense) counter protest and will update our website during and after the protest.

Nakba Day is commemorated on May 15, Israel’s declaration of independence day in 1948. The Jewish State, which follows the Jewish calendar for its “bank holidays,” celebrated the day on the 5th of Iyar (although this year, out of respect for Shabbat, we celebrated it on Thursday, Iyar 4). For the Arabs, it is an annual day of commemoration of the first day when their bad move at the UN Nov. 1947 partition vote blew in their faces, resulting in their succession of losses in their attempt to destroy the Jewish state—although they keep on trying.

It should be noted that as long as Israelis were determined to hold on to their right to settle anywhere in the Land of Israel, commemoration of the Nakba was being practiced by very few Arab citizens of Israel. The memories of 1948 were largely personal and communal, without a driving political component. But in the wake of the 1991 Madrid Conference, the first time Israel acquiesced to the concept of “Palestinian independence,” the observance of the Nakba has grown stronger and often violent. The Oslo Accords, which signaled that Israel was ready to capitulate on the fate of the liberated regions of Gaza, Judea, Samaria and the Golan, helped turn the Nakba craze into a regular day of confrontation between Arab Israeli youths and police, reminding many Israelis of the Arab pogroms of the 1920s and ’30s.

On Nakba Day 2011, egged on by the “Arab Spring,” Arabs from Judea and Samaria, the Gaza Strip, Lebanon and Syria marched towards the 1949 armistice (green line) borders, to mark their continued rejection of the right of the Jewish State to exist. At least twelve Arabs were killed and hundreds were wounded when the IDF blocked the zombie-fashion advance on the border fences by thousands of Syrian protesters who tried to forcibly enter the Golan Heights. Arabs also threw stones at Israeli soldiers guarding checkpoints in eastern Jerusalem, and the soldiers fired rubber bullets and tear gas in response.

A 2011 law empowers the Israeli finance minister to cut or reduce government funding to any NGO that organizes Nakba commemoration events.

UN Chemical Weapons Inspectors Arrive in Syria

UN inspectors tasked with investigating the alleged use of chemical weapons in Syria arrived there on Sunday, Xinhu reported.

The 20-member UN delegation, led by Swedish expert Ake Sellstrom, will begin their two-week mission today.

The Syrian government and the opposition have accused each other of using chemical weapons in an attack on Khan al-Asal town on March 19 that killed at least 25 people and injured 130 others, and both sides are denying responsibility.

The UN fact-finding mission, set up in March at the request of the Syrian government, will investigate the use of chemical weapons at the town of Khan al-Asal, outside Aleppo, and in two other sites.

The locations of two other incidents have not been publicized for security reasons. The UN investigation team’s mandate is to report on whether chemical weapons were used, and to specify what kind of chemical weapons was used. But they are not asked to determine the responsible party.

Radical, Democratic Changes to Egypt’s Constitution, MBs Out

The technical committee has been assigned the task of “amending” Egypt’s 2012 Muslim-Brothers inspired constitution is almost finished, Al Ahram reported. The committee is headed by Interim President Adly Mansour’s legal advisor, Ali Awad.

In a press conference Sunday, Awad told the press that the committee will finish its work Monday, and the new draft constitution will be announced Wednesday. Al Ahram quotes the basic instruction given the authors of the new document: “Fundamental changes must be introduced to 2012 Islamist-backed constitution.”

By fundamental, they mean no Muslim Brothers in politics, ever again.

“The 2012 constitution was drafted under the former regime of the Muslim Brotherhood to grant Islamists an upper hand and a final say in Egypt’s political future, and this must be changed now,” Ahram quotes a committee source. “When the people revolted 30 June, their main goals were not confined to removing Mohamed Morsi from power, but also changing the fundamental pillars of the religious tyranny the Muslim Brotherhood regime tried its best to impose on Egypt.”

The source revealed that the new constitution must impose a ban on political parties based on religious foundations.

The source explained that “the anticipated ban gained momentum after the committee received requests and proposals from more than 400 political, economic and social institutions, pressing hard for the necessity of safeguarding Egypt against Islamist factions trying to change the civil nature of the country into a religious oligarchy.”

Except that – surprise, surprise, despite the anti-Brotherhood sentiment common to the new masters of Egypt, the source says the new constitution “will keep Article 2 of 2012’s Islamist-backed constitution — which states that Islamic Sharia is the main source of legislation — in place.”

This, according to committee chairman Ali Awad, is done “in order to stress the Islamic identity of Egypt.”

According to the source, most political institutions have recommended that “if it is necessary to keep the Islamic Sharia article in place as a nod to Islamists like El-Nour, it is by no means necessary to maintain the 2012 constitution’s separate article (Article 219) that delivers an interpretation of Islamic Sharia.”

Article 219 of the 2012 constitution states: “The principles of Islamic Sharia include its generally-accepted interpretations, its fundamental and jurisprudential rules, and its widely considered sources as stated by the schools of Sunna and Gamaa.”

Not any more. They’re also going to scrap the Shura Council, the upper house of parliament, that was created in 1980 by late President Anwar El-Sadat to befriend his Islamist foes. They shot him anyway. The MB exploited its majority in the council in 2012 to “Brotherhoodise national press institutions and the state-owned Radio and Television Union (known as Maspero) and gain legislative powers to Islamise society.”

Sources are saying there will be radical changes of articles aimed at regulating the performance of the High Constitutional Court and media institutions. “We aim to reinforce the independence of these institutions and not to face any more intimidation by ruling regimes,” the source said. He also indicated that, “The electoral system is also expected to see a complete overhaul in order not to cause any discrimination against independents or come in favor of party-based candidates.”

And another noteworthy change: Article 232 of the 2012 constitution, imposing a ban on leading officials of Mubarak’s defunct ruling National Democratic Party (NDP), will be annulled.

So, it appears the Egyptians are quite capable of taking care of their legal affairs without nasty interventions from their patron wannabes in Washington. Perhaps it would be best for the U.S. to shut up for a couple of weeks and not meddle?

Arab Donald Duck Tweets for Israel to be ‘Demolished’

An Egyptian radio host who identifies himself as the official voice of Donald Duck on Disney Middle East called on Twitter for Israel to be “demolished.”

The discussion that began Sunday on the Twitter feed of Wael Mansour continued on Tuesday.

“I truly wish #Israel is demolished, I hate Zionism, I have so much hate inside me with every single child they murder or land they seize!” Mansour tweeted Sunday. The tweet followed one that read: “I saw a video of Israeli soldiers brutally arresting a palestinian woman in front of her 3 children coz they seized her home & she objects!” which could explain his Twitter outburst.

Mansour responded to some critics by tweeting: “I don’t know why insulting #Israel & #Zionism is “Anti-Semitic”?! They are just a bunch of Polish/ Ethiopian immigrants roughly 70 years old” and “There are Jews who hate Zionism; does it make them Jews Anti-Jews?! Of course NO! We respect Jews & disrespect Zionism, there’s a difference.”

The Algemeiner called on Disney chairman Bob Iger, who is Jewish, to respond to the controversy. Disney owns the rights to Donald Duck.

Contacted directly via Twitter by the Algemeiner, Mansour told the paper, “The Zionist entity is a racist entity by definition, performing crimes of hate by the power of its criminal law. I stand firm by what I said.”

Mansour said Egypt “dictates an overwhelming Islamic sentiment that happened normally. On the other hand, the Zionist entity is a bunch of immigrants stealing lands and creating a state based on a racist difference.”
