Justice Esther Chayut and Justice Hanan Meltzer agreed with the decision to recognize the petitioners as eligible, but noted that in general the issue of recognition and eligibility under the Law of Return should be considered with caution, and without preconceived rules.

The court ruled that the petitioners should be recognized as “Eligible for Return” and ordered the state to pay $5,000 for their legal expenses.
